SwissBooth Photobooth Rental Terms and Conditions
Article 1. Preamble
The Services offered by SwissBooth.ch, hereinafter referred to as "Services," are standard services designed to meet the needs and expectations of the majority of clients. It is the client's responsibility to ensure that the Services are suitable for their specific needs and expectations. By not having requested additional information from SwissBooth.ch prior to signing this agreement, the client acknowledges having been sufficiently informed.
Article 2. Definitions
"THE RENTER": Legal representative of the legal entity and any natural or legal person who enters into a rental service agreement with SwissBooth.ch.
"THE EQUIPMENT": All photobooth equipment and materials including the complete photobooth structure, touchscreen, Canon EOS reflex camera, DNP printer, Raspberry PI card, software, IT and electrical accessories, and party accessories.
"THE PROVIDER": Refers to SwissBooth.ch, represented by Diginnova Sàrl, 1167 Lussy-sur-Morges, route du Bon 20a – CHE-297.294.444, responsible for providing equipment rental, customer service, and technical support for photobooth use.
"SERVICES": Services offered by SwissBooth.ch and subscribed to by the Renter, including services and rentals.
Article 3. Reservations & Financial Terms
Service prices are indicated in Swiss Francs (CHF), including applicable VAT.
Reservations are only effective once payment has been received by SwissBooth.ch.
The Renter as a natural person shall pay 100% of the total amount by bank transfer to SwissBooth.ch upon signing the contract.
The Renter as a legal entity shall pay the total invoice amount by bank transfer to SwissBooth.ch within 30 days from the invoice date.
The Renter has the right to cancel their order up to 10 days before the Service date. The payment will be refunded; after this deadline, 50% of the payment made will be retained.
Article 4. Damages, Loss/Theft
In case of damages attributable to use not in accordance with the instructions given by the lessor at delivery, theft, or loss, the Renter will be held responsible and will bear the costs of restoration or replacement, upon presentation of payment receipts.
Article 5. Assignment – Subletting
The Renter may not sublet, resell, or transfer the Equipment.
Transportation risks are the responsibility of the Renter when the free delivery option is not included.
The Renter agrees to return the equipment in the same condition and working order as at the time of receipt.
The Renter agrees to use the Equipment for legal purposes and in accordance with normal use of the Equipment and good morals. Under no circumstances can the Provider be held responsible for photos taken with the equipment provided.
The Renter agrees to take care of and protect the integrity of the Equipment. If the Renter returns the Equipment in poor condition, poorly maintained, or in a state of technical malfunction or cleanliness not corresponding to normal use or rental wear, noted within 7 days following the return, the Renter agrees to pay for restoration, repair, or cleaning costs, upon presentation of corresponding invoices.
In case of loss or theft, the owner will pursue legal action.
The Renter is responsible for the equipment from the moment it leaves the owner or, in case of on-site setup, at the moment of availability to users.
Article 6. Insurance
The Renter is not covered by any SwissBooth.ch insurance.
It is the Renter's responsibility to obtain insurance from a company of their choice to cover their Civil Liability (to cover damages caused to third parties by the equipment), risks of loss, theft, or deterioration during the entire rental period until the return or collection of the equipment.
In case of loss, theft, or deterioration, the Renter must reimburse SwissBooth.ch for the equipment concerned based on the value of new equipment purchased as replacement.
At the time of delivery, the Renter will receive the necessary information for the operation and handling of the equipment as well as all safety warnings, risks, and precautions to be taken related to the use of the equipment described in this contract.
The Renter will therefore be held responsible for any misuse and resulting damages.
In case of total or partial malfunction of the equipment due to paper jam and/or ribbon breakage or other malfunction explained during setup, the equipment owner cannot be held responsible and the full rental amount and any repairs must be paid by the Renter.
In case of total or partial malfunction of the equipment due to the action of a third party, unsuitable climatic environment, malfunction of the electrical and/or web network, the equipment owner cannot be held responsible and the full rental amount and any repairs must be paid by the Renter.
Under no circumstances can the owner be held responsible for any bodily or material damage resulting from the use of their equipment by the Renter having accepted the perfect working condition of the equipment by signing this contract and/or the delivery note.
Rented equipment: Complete SwissBooth.ch structure + touchscreen, Canon EOS reflex camera, DNP printer, Raspberry PI card, software, IT and electrical accessories, and party accessories.
Article 7. Phone Support
The Renter benefits from technical phone support during their rental period via a phone messaging group between 9:00 AM and 11:00 PM.
Article 8. Jurisdiction
In case of dispute arising from the interpretation or execution of this contract, only the Commercial Court of Lausanne based in the canton of Vaud in Switzerland shall have jurisdiction.
